Key Types of Intellectual Property and Related Laws:
- Patents:
- Patents Act, 1970 (amended in 2005): Governs the granting of patents in India. A patent provides exclusive rights to an inventor for a new and useful invention, product, or process. The Act was significantly amended to comply with the TRIPS Agreement (Trade-Related Aspects of Intellectual Property Rights) under the WTO.
- Term: Patents are granted for a period of 20 years from the filing date.
- Trademarks:
- Trademarks Act, 1999: Regulates the registration, protection, and enforcement of trademarks in India. A trademark is a sign, symbol, or word that distinguishes goods or services of one entity from those of others.
- Term: Registered trademarks are valid for 10 years, renewable indefinitely.
- Copyright:
- Copyright Act, 1957 (amended in 2012): Protects the rights of creators of literary, dramatic, musical, and artistic works, as well as cinematograph films and sound recordings. Copyright grants the creator exclusive rights to reproduce, distribute, and perform the work.
- Term: Generally, the life of the author plus 60 years for literary, dramatic, musical, and artistic works.
- Designs:
- Designs Act, 2000: Protects the aesthetic appearance of articles, including shape, configuration, pattern, and ornamentation applied to an article. A design must be new and original to qualify for protection.
- Term: Protection is granted for 10 years, extendable by an additional 5 years.
- Geographical Indications (GIs):
- Geographical Indications of Goods (Registration and Protection) Act, 1999: Protects products that have a specific geographical origin and possess qualities or a reputation due to that origin (e.g., Darjeeling tea, Basmati rice).
- Term: GIs are registered for 10 years and can be renewed indefinitely.
- Trade Secrets and Confidential Information:
- No specific statute: Trade secrets are protected under contract law, equity, and principles of common law. Businesses often use non-disclosure agreements (NDAs) and confidentiality agreements to protect their trade secrets.
